વંચાણ હેઠળના ક્રમાંક (૧) પરના જાહેરનામા દ્વારા ગુજરાત મુલ્કી સેવા (પેન્શન) નિયમો, ૨૦૦૨ લાગુ કરવામાં આવેલ છે. વંચાણ હેઠળના ક્રમાંક (૨) પરના તા.૧૮/૦૩/૨૦૦૫ના ઠરાવથી તા.૦૧/૦૪/૨૦૦૫ કે ત્યારબાદ નિયમિત નિમણૂક પામેલ અધિકારી/કર્મચારીઓને નવી વર્ધિત પેન્શન યોજના (એન.પી.એસ.) હેઠળ આવરી લેવામાં આવેલ છે. વંચાણ હેઠળના ક્રમાંક (૩) પરના જાહેરનામાથી ગુજરાત મુલ્કી સેવા (પેન્શન) નિયમો, ૨૦૦૨ ની પાત્રતા બાબતે સ્પષ્ટતા કરવામાં આવેલ છે. વંચાણ હેઠળના ક્રમાંક (૪) પરના તા.૧૫/૦૩/૨૦૨૪ના જાહેરનામાથી નવી વર્ધિત પેન્શન યોજના (એન.પી.એસ.) હેઠળના કર્મચારીઓ માટે ગુજરાત મુલ્કી સેવા (નવી વર્ધિત પેન્શન યોજના) નિયમો, ૨૦૨૪ લાગુ કરવામાં આવેલ છે.
રાજય સરકારમાં વિવિધ સંવર્ગના જે અધિકારી/ કર્મચારીઓની તા.૦૧/૦૪/૨૦૦૫ પહેલા ફિક્સ પગારમાં નિમણૂક કરવામાં આવેલ હોય અને તેમની નિયમિત નિમણૂક તા.૦૧/૦૪/૨૦૦૫ પછી થઈ હોય અથવા તા.૦૧/૦૪/૨૦૦૫ પહેલા ભરતી પ્રક્રિયા પૂર્ણ થઈ ગયેલ હોય પરંતુ વહીવટી કારણોસર તેમની નિમણૂક તા.૦૧/૦૪/૨૦૦૫ પછીની હોય તેઓને જુની પેન્શન યોજનાનો લાભ આપવાની બાબત સરકારશ્રીની વિચારણા હેઠળ હતી. પુખ્ત વિચારણાને અંતે આથી નીચે મુજબ ઠરાવવામાં આવે છે.
ઠરાવ:
૧.માન્ય ભરતી બોર્ડ મારફત સ્પર્ધાત્મક પરીક્ષા પધ્ધતિ દ્વારા (લેખિત પરીક્ષા, ઈન્ટરવ્યુ અને પરિણામની જાહેરાત) પસંદગી પ્રકીયા પૂર્ણ થયેલ હોય અથવા રાજયમાં વિવિધ વિભાગોની ફિકસ પગારની નીતિ હેઠળ સરકારી તેમજ માન્યતા પ્રાપ્ત બિન-સરકારી અનુદાનિત સંસ્થાઓમાં સક્ષમ કક્ષાએથી મંજૂર થયેલ જગ્યાઓ પર માન્ય ભરતી પ્રક્રિયા મારફતે તા.૦૧/૦૪/૨૦૦૫ પહેલા પસંદગીની પ્રક્રિયા પૂર્ણ થયેલ હોય, તેવા નીચે મુજબના કેસોમાં જૂની પેન્શન યોજનાનો લાભ મળવાપાત્ર થશે.
(અ)સંબંધિત સંવર્ગની ભરતી અંગેનું પરિણામ તા.૦૧/૦૪/૨૦૦૫ પહેલા જાહેર થયેલ હોય પરંતુ વહીવટી કારણોસર અથવા કોર્ટ કેસ પડતર હોવાના કારણે નિમણૂંક તા.૦૧/૦૪/૨૦૦૫ના રોજ કે ત્યારબાદ આપવામાં આવેલ હોય,
(બ)સંબંધિત સંવર્ગની ભરતી અંગેનું પરિણામ તા.૦૧/૦૪/૨૦૦૫ પહેલા જાહેર થયેલ હોય પરંતુ વહીવટી કારણોસર અથવા કોર્ટ કેસ પડતર હોવાના કારણે ફિક્સ પગારમાં નિમણૂંક તા.૦૧/૦૪/૨૦૦૫ના રોજ કે ત્યારબાદ આપવામાં આવેલ હોય તેમજ ફિકસ પગારનો નિયત સમયગાળો સંતોષકારક રીતે પૂર્ણ કરી નિયમિત નિમણૂક પામેલ હોય,
(ક)(૧)તા.૦૧/૦૪/૨૦૦૫ પહેલા ફિક્સ પગારમાં નોકરીમાં જોડાયા હોય અને તા.૦૧/૦૪/૨૦૦૫ પછી ફિકસ પગારનો નિયત સમયગાળો સંતોષકારક રીતે પૂર્ણ કરી નિયમિત નિમણૂક પામેલ હોય,
(૨)તેમજ ઉકત(૧)માં સૂચવેલ કર્મચારીઓ પૈકી જેઓ સીધી ભરતીથી અન્ય સંવર્ગમાં નિયમિત નિમણૂક પામેલ હોય અને જેઓની સેવાઓ નાણા વિભાગની સંમતિથી જોડવામાં આવેલ હોય.
આ ઠરાવની જોગવાઈઓ જે કચેરીઓમાં તા. ૦૧/૦૪/૨૦૦૫ પહેલા રાજ્ય સરકારની જૂની પેન્શન યોજના લાગુ પડતી હોય તેવી કચેરીઓને જ લાગુ પડશે. તે સિવાયની અન્ય કોઈ કચેરીઓને લાગુ પડશે નહી. ૨.આ અંગેની વિગતવાર સૂચનાઓ હવે પછી પ્રસિધ્ધ કરવામાં આવશે.

Matter of giving benefit of Old Pension Scheme to Officers/Employees

Introduction:
The Gujarat Civil Service (Pension) Rules, 2002 have been implemented vide notification at number (1) below. Resolution dated 18/03/2005 on No. (2) under reading, officers/employees appointed regularly on or after 01/04/2005 are covered under the New Enhanced Pension Scheme (NPS). The notification at number (3) under the reading clarifies the eligibility of the Gujarat Civil Service (Pension) Rules, 2002. The Gujarat Civil Service (New Enhanced Pension Scheme) Rules, 2024 have been implemented for employees under the New Enhanced Pension Scheme (NPS) vide notification dated 15/03/2024 at No. (4) under Deduction.
Officers/employees of various cadres in the State Government who were appointed on fixed pay before 01/04/2005 and whose regular appointment was made after 01/04/2005 or whose recruitment process was completed before 01/04/2005 But due to administrative reasons, their appointment was after 01/04/2005, the matter of giving them the benefit of the old pension scheme was under the consideration of the Government. Mature consideration is finally hereby resolved as follows.
Resolution:
1.Completed selection process through competitive examination method (written test, interview and declaration of result) through recognized recruitment board or approved by competent level in government as well as recognized non-government aided institutions under fixed pay policy of various departments in the state.
The old pension scheme will be available in the following cases where the selection process has been completed before 01/04/2005 through the approved recruitment process.
(a) the result of the recruitment of the concerned cadre has been declared before 01/04/2005 but the appointment has been made on or after 01/04/2005 due to administrative reasons or pending court cases,
(b) The result of the recruitment of the concerned cadre has been announced before 01/04/2005 but due to administrative reasons or pending court cases, the appointment on fixed pay has been given on or after 01/04/2005 and the fixed period of fixed pay is satisfactory. duly completed and regularly appointed,
(a)(1) Joined the service on fixed pay before 01/04/2005 and after satisfactorily completed the fixed period of fixed pay and was appointed regularly after 01/04/2005,
(2)Also among the employees referred to in clause (1) who have been regularly appointed in other cadres by direct recruitment and whose services have been combined with the consent of the Finance Department.
The provisions of this resolution in the offices dt. It will be applicable only to the offices where the old pension scheme of the State Government was applicable prior to 01/04/2005. It will not be applicable to any other offices other than that. 2. Detailed instructions in this regard will be published later.
