ગુજરાત પ્રાથમિક શિક્ષણ અધિનિયમ, 1947
નં. K/SH153/2025/ED/MIS/e-tile/3t2021/3057/CH:-
જ્યારે કે ગુજરાત સરકારને સંતોષ થયો છે કે પરિસ્થિતિ એવી છે કે નિયમો બનાવવામાં તાત્કાલિક કાર્યવાહી કરવાની અને અગાઉની પ્રકાશન પ્રક્રિયા ટાળવાની જરૂર છે, જે ગુજરાત પ્રાથમિક શિક્ષણ અધિનિયમ, 1947 (Bom. LXI of 1947)ની કલમ 63ની ઉપકલમ (3) હેઠળ પ્રદાન કરવામાં આવેલ છે;
હવે, તેથી, કલમ 53ની ઉપકલમ (1) તથા કલમ 23ની ઉપકલમ (3) દ્વારા મળેલ અધિકારોનો ઉપયોગ કરીને, ગુજરાત સરકાર નીચેના નિયમો બનાવે છે, જે હેડ ટીચર, વર્ગ–III (જિલ્લા પ્રાથમિક શિક્ષણ સમિતિઓ અને મહાનગરપાલિકા પ્રાથમિક શિક્ષણ સમિતિઓ) ભરતી નિયમો, 2016માં વધુ સુધારો કરે છે:
1. ટૂંકુ શીર્ષક અને અમલ
(1) આ નિયમોને હેડ ટીચર, વર્ગ–III, જિલ્લા પ્રાથમિક શિક્ષણ સમિતિઓ અને મહાનગરપાલિકા પ્રાથમિક શિક્ષણ સમિતિઓ, ભરતી (સુધારો) નિયમો, 2025 કહેવાશે.
(2) તેઓ સત્તાવાર ગેઝેટમાં પ્રકાશિત થતી તારીખે અમલમાં આવશે.
2. ભરતીના નિયમોમાં સુધારા
(i) નિયમ 2ની કલમ (a) માં “by promotion of a person of proved merit and efficiency” શબ્દો બદલવામાં આવી “by promotion of a person who possesses ‘Good’ benchmark...” નાખવામાં આવશે.
(ii) કલમ (b) પછી “or” ઉમેરાશે.
(iii) કલમ (b) પછી નીચેની કલમ (c) ઉમેરાશે:
“(c) વિશેષ સ્પર્ધાત્મક પરીક્ષાના પરિણામના આધારે પ્રમોશન... શરતે કે વ્યક્તિ
1. ઓછીમાં ઓછા પાંચ વર્ષ સુધી લોવર પ્રાઇમરી ટીચર કે અપ્પર પ્રાઇમરી ટીચર તરીકે સેવા આપી હોય;
2. કમ્પ્યુટર જ્ઞાનની લાયકાત પરીક્ષા પાસ કરી હોય;
3. સરકાર દ્વારા નિર્ધારિત નિયમો મુજબ વિશેષ સ્પર્ધાત્મક પરીક્ષા પાસ કરી હોય.”
3. નિયમ 3માં સુધારો
ક્લોઝ (a) બદલીને નીચે મુજબ કરાશે:
“(a) પ્રમોશન, સીધી ભરતી અને વિશેષ સ્પર્ધાત્મક પરીક્ષાના આધારે નિમણૂક અનુક્રમે 1:1:2ના પ્રમાણમાં કરવામાં આવશે.”

ગુજરાત સરકારને ખાતરી છે કે ગુજરાત પ્રાથમિક શિક્ષણ અધિનિયમ, ૧૯૪૭ (૧૯૪૭નો બોમ્બ LXI) ની કલમ ૬૩ ની પેટા-કલમ (૩) ની જોગવાઈ હેઠળ નિયમો બનાવવા અને તેના અગાઉના પ્રકાશનને તાત્કાલિક ધોરણે રદ કરવા માટે તાત્કાલિક પગલાં લેવા જરૂરી બને તેવા સંજોગો અસ્તિત્વમાં છે; તેથી, હવે, ગુજરાત પ્રાથમિક શિક્ષણ અધિનિયમ, ૧૯૪૭ (૧૯૪૭નો બોમ્બ LXI) ની કલમ ૨૩ ની પેટા-કલમ (૩) સાથે વાંચીને કલમ ૬૩ ની પેટા-કલમ (૧) દ્વારા મળેલી સત્તાઓનો ઉપયોગ કરીને, ગુજરાત સરકાર આથી પ્રાથમિક શિક્ષણ નિયામક, જિલ્લા પ્રાથમિક શિક્ષણ સમિતિ અને મ્યુનિસિપલ પ્રાથમિક શિક્ષણ સમિતિ, ભરતી નિયમો, ૨૦૧૬ માં મુખ્ય શિક્ષક, વર્ગ III માં વધુ સુધારો કરવા માટે નીચેના નિયમો બનાવે છે, એટલે કે: -
૧. (૧) પ્રાથમિક શિક્ષણ નિયામક, જિલ્લા પ્રાથમિક શિક્ષણ સમિતિઓ અને મ્યુનિસિપલ પ્રાથમિક શિક્ષણ સમિતિ, ભરતી (સુધારા) નિયમો, ૨૦૨૫ માં આ નિયમોને મુખ્ય શિક્ષક, વર્ગ III કહી શકાય.
(૨) તેઓ સત્તાવાર ગેઝેટમાં તેમના પ્રકાશનની તારીખથી અમલમાં આવશે.
૨. પ્રાથમિક શિક્ષણ નિયામકમંડળ, જિલ્લા પ્રાથમિક શિક્ષણ સમિતિઓ અને મ્યુનિસિપલ પ્રાથમિક શિક્ષણ સમિતિ, ભરતી નિયમો, ૨૦૧૬ (ત્યારબાદ "ઉક્ત નિયમો" તરીકે ઓળખાશે), નિયમ ૨ માં, મુખ્ય શિક્ષક, વર્ગ ૩ માં,
(i) કલમ (a) માં, "સાબિત યોગ્યતા અને કાર્યક્ષમતા ધરાવતી વ્યક્તિની બઢતી દ્વારા" શબ્દોની જગ્યાએ, ગુજરાત સિવિલ સર્વિસીસ વર્ગીકરણ અને ભરતી (જનરલ) નિયમો, ૧૯૬૭ માં નિર્ધારિત વિચારણાના ક્ષેત્રમાં બઢતી માટે યોગ્ય ગણવામાં આવતા "સારા" માપદંડ ધરાવતી વ્યક્તિની બઢતી દ્વારા" શબ્દો વાપરવામાં આવશે.
(ii) કલમ (b) માં, "અથવા" શબ્દ ઉમેરવામાં આવશે
(iii) કલમ (b) પછી નીચેનો કલમ (c) દાખલ કરવામાં આવશે, એટલે કે: -
"(c) ગુજરાત સિવિલ સર્વિસીસ વર્ગીકરણ અને ભરતીમાં નિર્ધારિત વિચારણાના ક્ષેત્રમાં બઢતી માટે યોગ્ય ગણાતા "સારું" માપદંડ ધરાવતી વ્યક્તિની ખાસ સ્પર્ધાત્મક પરીક્ષાના પરિણામના આધારે બઢતી દ્વારા.
(સામાન્ય) નિયમો, ૧૯૬૭ વ્યક્તિઓમાંથી, જેઓ,
(i) પ્રાથમિક શિક્ષણ નિયામકની ગૌણ સેવાઓમાં નીચલા પ્રાથમિક શિક્ષક અથવા ઉચ્ચ પ્રાથમિક શિક્ષક, વર્ગ III ના સંવર્ગમાં ઓછામાં ઓછા પાંચ વર્ષ સુધી કામ કર્યું હોય, અથવા જિલ્લા પ્રાથમિક શિક્ષણ સમિતિ અથવા મ્યુનિસિપલ પ્રાથમિક શિક્ષણ સમિતિ;
(ii) ગુજરાત સિવિલ સર્વિસીસ કોમ્પ્યુટર કોમ્પિટન્સી તાલીમ અને પરીક્ષા નિયમો, 2006 ની જોગવાઈઓ અનુસાર કોમ્પ્યુટર જ્ઞાન માટેની લાયકાત પરીક્ષા પાસ કરી હોય; અને સરકાર દ્વારા નિર્ધારિત નિયમો અનુસાર ખાસ સ્પર્ધાત્મક પરીક્ષા પાસ કરી હોય."
(iii) ઉપરોક્ત નિયમોમાં, નિયમ 3 માં, કલમ (a) ની જગ્યાએ, નીચેની કલમ ઉમેરવામાં આવશે, એટલે કે: -
"(a) બઢતી દ્વારા, સીધી પસંદગી દ્વારા અને ખાસ સ્પર્ધાત્મક પરીક્ષા દ્વારા નિમણૂક અનુક્રમે 1:1:2 ના ગુણોત્તરમાં કરવામાં આવશે".

Gujarat Primary Education Act. 1947

WHEREAS the Government of Gujarat is satisfied that circumstances exist which render it necessary to take immediate action to make rules and dispense with the previous publication thereof under the proviso to sub-section (3) of section 63 of the Gujarat Primary Education Act, 1947 (Bom. LXI of 1947); NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of section 63 read with sub-section (3) of section 23 of the Gujarat Primary Education Act, 1947 (Bom. LXI of 1947), the Government of Gujarat hereby makes the following rules further to amend the Head Teacher, Class III, in the Directorate of Primary Education District Primary Education Committee and Municipal Primary Education Committee, Recruitment Rules, 2016, namely: -
1. (1) These rules may be called the Head Teacher, Class III, in the Directorate of Primary Education District Primary Education Committees and Municipal Primary Education Committee, Recruitment (Amendment) Rules, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Head Teacher, Class III, in the Directorate of Primary Education District Primary Education Committees and Municipal Primary Education Committee, Recruitment Rules, 2016 (hereinafter referred to as "the said rules"), in rule 2,
(i) in clause (a), for the words "by promotion of a person of proved merit and efficiency "the words", by promotion of a person who possesses "Good" benchmark for being considered fit for promotion within the zone of consideration as laid down in the Gujarat Civil Services Classification and Recruitment (Genera) Rules, 1967" shall be substituted.
(ii) in clause (b), the word "or" shall be added
(iii) after clause (b) the following clause (c) shall be inserted, namely: -
"(c) by promotion on the basis of the result of special competitive examination of a person who possesses "Good" benchmark for being considered fit for promotion within the zone of consideration as laid down in the Gujarat Civil Services Classification and Recruitment
(General) Rules, 1967 from amongst the persons, who, (i) have worked for not less than five years in the cadre of Lower Primary Teacher or Upper Primary Teacher, Class III in the subordinate services of the Directorate of Frimary Education, or District Primary Education Committee or Municipal Primary Education Committee;
(ii) have passed the qualifying examination for computer knowledge in accordance with the provisions of the Gujarat Civil Services Computer Competency Training and Examination Rules, 2006; and have passed the Special Competitive Examination in accordance with the rules prescribed by the Government."
(iii) In the said rules, in rule 3, for clause (a), the following clause shall be substituted, namely: -
"(a) Appointment by promotion, by direct selection and by special competitive examination shall be made in the ratio of 1:1:2, respectively".
